Terms & Conditions of Carriage and Services
Effective Date: 19 February 2026
These Terms and Conditions (“Terms”) govern all transportation, courier, logistics, warehousing, cargo handling, and related services provided by Antora Express (“Company”, “We”, “Us”, or “Our”). By booking, tendering goods, or using the Company’s services, the Consignor, Consignee, or Customer agrees to be bound by these Terms.
1. Acceptance of Consignment
All consignments are accepted subject exclusively to these Terms. No employee, agent, or representative has authority to modify these Terms unless expressly authorized in writing by the Company.
Acceptance of goods or use of services shall constitute full agreement to these Terms by the Consignor and Consignee.
2. Scope of Work / Scope of Services
The Company provides logistics and transportation services including, but not limited to:
- Road transportation (Full Truck Load / Part Load / Express cargo)
- Door-to-door delivery where specifically agreed
- Intercity and interstate movement of goods
- Project cargo and ODC movement where contracted
- Warehousing, storage, and distribution services
- Cargo handling and logistics coordination
- Multimodal transport through authorized partners.
Unless expressly agreed in writing, the Company’s services do not include:
- Loading or unloading at origin or destination
- Packing, unpacking, or palletization
- Cargo insurance
- Customs clearance or statutory documentation
- Crane services, escorts, or special equipment
- Handling of hazardous or regulated goods
- Any service not specifically mentioned in the booking or contract
Any additional services requested shall be subject to separate charges and written confirmation by the Company.
3. Owner’s Risk
Unless expressly agreed otherwise in writing, all goods are transported, stored, and handled strictly at Owner’s Risk. The Company shall exercise reasonable care but shall not be deemed an insurer of the goods.
4. Description, Packaging & Documentation
The Consignor warrants that:
- The description, weight, dimensions, and value of goods are accurate
- Goods are properly packed for safe transportation
- Packaging complies with industry standards
- All required documents and permits accompany the consignment
- Goods are suitable for transport by the selected mode
The Company shall not be liable for loss or damage caused by improper packing, inherent defects, or incorrect declaration.
5. Prohibited & Restricted Goods
The Company reserves the right to refuse carriage of any goods at its discretion. Without prior written approval, the following shall not be accepted:
- Hazardous, explosive, flammable, or toxic materials
- Illegal or contraband items
- Currency, bullion, precious metals, jewelry, valuables
- Perishable goods without proper disclosure
- Goods requiring special permits not provided
- Any goods prohibited by applicable law
The Consignor shall indemnify the Company against all consequences arising from shipment of such goods.
6. Right of Inspection
The Company reserves the right to open, inspect, scan, or verify any consignment at any time for safety, operational, or regulatory purposes.
7. Liability Limitation
The Company shall not be liable for any loss, damage, delay, deterioration, or non-delivery except where directly caused by proven negligence of the Company.
In any event, liability shall be limited to the lowest of:
- Freight charges paid for the consignment, OR
- Declared value of goods, OR
- Maximum liability cap determined by Company policy
The Company shall not be liable for indirect, incidental, consequential, or commercial losses, including loss of profit or business interruption.
8. Insurance
Goods are not insured by the Company unless specifically requested and confirmed in writing. Customers are advised to arrange independent insurance coverage appropriate to the value and nature of the goods.
9. Transit Time & Delivery Schedule
Any transit time or delivery schedule communicated is indicative only and not guaranteed. The Company shall not be liable for delays arising from operational constraints or circumstances beyond its control.
10. Delivery
Delivery shall be made to the Consignee or authorized representative at the destination specified or at the Company’s delivery point. Production of the original consignment note, proof of identity, or authorization may be required.
Delivery acknowledgment shall constitute complete discharge of the Company’s responsibility.
11. Undelivered or Unclaimed Goods
If delivery cannot be effected due to incorrect address, refusal, absence of Consignee, or other reasons, the Company may store or return the goods at the risk and expense of the Consignor or Consignee.
Goods remaining unclaimed for more than 90 days may be sold or disposed of to recover outstanding charges without further notice.
12. Storage, Demurrage & Additional Charges
Storage, demurrage, detention, or handling charges shall apply for goods not collected within the prescribed free period after arrival. Additional charges may also apply for waiting time, diversion, or special handling.
13. Government Actions & Legal Compliance
The Company shall not be liable for loss, damage, or delay caused by seizure, detention, inspection, or action by government authorities, customs, police, or regulatory bodies.
14. Force Majeure
The Company shall not be liable for failure or delay due to events beyond its reasonable control, including but not limited to natural disasters, accidents, strikes, riots, war, epidemics, government restrictions, or infrastructure disruptions.
15. Subcontracting
The Company reserves the right to engage third-party carriers, agents, or subcontractors to perform any part of the services. Such engagement shall not increase the Company’s liability.
16. Freight, Charges & Lien
Freight and related charges shall be payable as agreed. The Company reserves the right to:
- Recalculate charges based on actual weight, dimensions, or route
- Recover additional expenses incurred
- Retain possession of goods as lien for unpaid dues
17. Claims Procedure
Any claim for loss or damage must:
- Be submitted in writing within 7 days of delivery or expected delivery
- Be supported by relevant documents and evidence
- Be subject to inspection and verification by the Company
Failure to comply with these requirements shall result in rejection of the claim.
18. Fragile, Liquid & Perishable Goods
The Company shall not be responsible for leakage, breakage, spoilage, or deterioration of fragile, liquid, or perishable goods unless caused by proven mishandling by the Company.
19. Indemnity
The Consignor and Consignee agree to indemnify and hold the Company harmless against all losses, liabilities, penalties, or expenses arising from incorrect information, illegal goods, improper packaging, or breach of these Terms.
20. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts at the location of the Company’s registered office.
21. Modification of Terms
The Company reserves the right to amend these Terms at any time. Updated Terms shall apply to all future consignments and services.
